Pending Appeals & Variances

A pending variances or appeal application is an application that has been submitted to Planning & Inspections, but a decision has not been rendered by the Board of Adjustment.

The public is invited to attend the meetings, which are held in the Commissioners Room on the third floor of the:

Zoning cases are split into two categories, Quasi-Judicial and Legislative, with different rules and procedures applying to each. A simplified guide to the differences in the cases is available here. Please read prior to planning to speak at a public hearing.

VAR #415* Thomas Williams
A request for variances from Section of the Lincoln County Unified Development Ordinance to permit four lots in the Eastwind Cove subdivision to exceed 2,000 square feet of impervious coverage not including structures, with the proposed paved area for each lot ranging from 3,483 square feet to 4,251 square feet. The lots are located on Lake Norman on the west side of Rivendell Road about 1,200 feet north of Webbs Road in Catawba Springs Township. Section states that all area and dimensional standards in a Planned Development district shall be established by the Board of Commissioners at the time of approval. The standards established for Eastwind Cove limit the built-upon area for structures to 20 percent of the lot area and all other impervious coverage to 2,000 square feet.
 VAR #416*  Simon and Dana Martin A request for a variance from Section 4.6.2.C.2(c) of the Lincoln County Unified Development Ordinance to permit a side yard setback of five (5) feet for a proposed detached garage. The 0.8-acre parcel is located at 4400 Pine Harbor Drive about 400 feet east of Windy Pine Circle in Catawba Springs Township. Section 4.6.2.C.2(c) states that the minimum side yard setback for a residential accessory structure is 10 feet.  11/28/2016
 VAR #417*  Robert and Lori Tyson A request for a variance from Section 2.4.5.C of the Lincoln County Unified Development Ordinance to permit a rear yard setback of 13 feet for an existing house. The 0.68-acre parcel is located at 4762 Trails End Road, at the end of Trails End Road about 1,800 feet off Burton Lane, in Catawba Springs Township. Section 2.4.5.C states that the minimum rear yard setback in the R-SF (Residential Single-Family) district is 40 feet.  11/28/2016
