ADVERTISEMENT FOR BIDS

Sealed bids for the project entitled Airlie Business Park at Ingleside – Phase 2 will be received by Lincoln County at 2:00 pm local time February 28, 2013 at the County Chambers, care of John Isenhour, Purchasing Office, on the third floor of the Citizen’s Center (115 West Main Street in Lincolnton, North Carolina 28092) and then publicly opened and read aloud.

THE PROJECT GENERALLY CONSISTS OF widening approximately 800 linear feet of Optimist Club Road as well as the construction of approximately 3,900 linear feet of 34-foot wide curb and guttered industrial access roadway with associated stone and asphalt pavement structures, grading, drainage facilities, erosion control measures, and seeding/grassing and restoration.

Copies of the Contract Documents may be obtained at the office of the Engineer, McGill Associates, P.A., located at 1240 19th Street Lane NW, Hickory, North Carolina 28601 or Post Office Box 1136, Hickory, North Carolina 28603 upon payment of $150.00 for each set. There will be no refund to any party for Contract Documents so obtained. Neither the Owner nor the Engineer will be responsible for full or partial sets of Contract Documents, including any Addenda, obtained from any other source. Up-to-date planholders, addenda, etc., may be found at www.mcgillengineers.com.

A mandatory Pre-Bid Conference will be held at 2:00 pm on February 12, 2013 at the County Citizen’s Center (115 West Main Street in Lincolnton, North Carolina 28092). Interested parties are invited to attend this meeting to review the plans, ask for additional information or clarifications, review the required Minority Business Enterprise (MBE forms), and visit the project site. Also, attendees will earn ten (10) points toward meeting their MBE good faith effort goal.

Bidders and other interested parties should note that prequalification of equipment manufacturers by the Engineer prior to the bid opening may be required for this project. Equipment prequalification requirements, if any, are described in the Contract Documents.

A certified check or cashiers check payable to Lincoln County (hereafter called Owner) or a satisfactory Bid Bond executed by a corporate surety licensed under the laws of North Carolina to execute such bonds in the amount equal to five percent of the total of the bid shall be submitted with each bid.

The Owner reserves the unqualified right to reject any or all offers, waive any informality in the proposal and unless otherwise specified by the Offeror (Bidder), to accept any item or part of the proposal if determined to be in the best interest of the County. The Owner reserves the right to award a contract to the lowest, responsive, responsible bidder.

The successful bidder shall be required to furnish separate, 100 percent Performance and Payment Bonds in compliance with North Carolina General Statutes Section 143-129 and of Article 3 of Chapter 44A. The Performance Bond shall be in full force and effect for one (1) year after the date of final acceptance of the project by the Owner.

The bid deposit shall be retained by the Owner if the successful bidder fails to execute the contract or fails to provide the required bonds, as stated above, within ten (10) days after award of the contract.

Each bidder must be appropriately licensed as a Contractor in the State of North Carolina as provided in General Statutes Chapter 87. Each bidder shall make positive efforts to use small and minority owned business enterprises on this project.

A conditional or qualified BID will not be accepted.

Requirements for all Lincoln County Contracts:
AFFIRMATIVE ACTION: The Contractor will take affirmative action in complying with all Federal and State requirements concerning fair employment and employment of people with disabilities, and concerning the treatment of all employees without regard to discrimination by reason of race, color, religion, sex, national origin, or disability.
Title VI is part of the Civil Rights Act of 1964, as amended, and its implementing regulations provide that no person shall be subject to discrimination on the basis of race, color, or national origin under any program or activity that receives Federal financial assistance.
For purposes here, “national origin” equates to individuals who have a limited proficiency with the English language and their primary language is not English, hence the term “limited English proficiency” or LEP.
